Article 1:

These regulations have been drawn up in accordance with Articles L.6352-3 and L.6352-4 and R.6352-1 to R.6352-15 of the French Labor Code. It applies to all trainees, for the duration of the training course.

Article 2: Discipline

Trainees are strictly forbidden to:

  • Bringing alcoholic beverages onto the organization’s premises;
  • Attending training courses while intoxicated;
  • Take away or modify training materials;
  • Change computer parameter settings;
  • Eating in the classrooms;
  • Use their cell phones during sessions for purposes other than training;

Article 3: Penalties

Depending on the nature and seriousness of the misconduct, the management of the training organization may impose one or other of the following sanctions, in ascending order of importance:

  • Written warning from the Director of the training organization;
  • Blame
  • Permanent exclusion from training

Article 4: Pre-sanction interview and procedure

No penalty may be imposed on a trainee without the latter being informed at the same time, in writing, of the grievances against him/her. When the training organization is considering imposing a sanction, it summons the trainee by registered letter with acknowledgement of receipt, or by hand-delivered against receipt, indicating the purpose of the summons and the date, time and place of the meeting, unless the proposed sanction does not affect the trainee’s attendance for the remainder of the training course.
During the interview, trainees can be assisted by a person of their choice, either a trainee or an employee of the training organization. The notice of meeting referred to in the previous article mentions this option. During the interview, the trainee is informed of the reason for the envisaged sanction, and is given the opportunity to provide any explanation or justification for the facts of which he or she is accused.

When the training organization considers a temporary exclusion with immediate effect to be essential, no definitive sanction relating to the misconduct which led to the exclusion may be taken without the trainee having first been informed of the grievances against him/her and, if applicable, having been summoned to an interview and given the opportunity to explain himself/herself before a Disciplinary Committee.
Sanctions may not be imposed less than one clear day or more than 15 days after the interview or, where applicable, after the Disciplinary Committee has given its opinion.
The trainee is notified in writing of the reasons for the decision, by registered letter or letter delivered against receipt. At the same time, the training organization informs the employer and, if applicable, the joint body paying the training costs, of the sanction taken.

Article 5: Trainee representation

When the duration of an internship exceeds 500 hours, one full delegate and one alternate delegate are elected in a two-round uninominal ballot. All trainees are eligible to vote, with the exception of prisoners admitted to take part in a vocational training course.
The training organization organizes the ballot, which takes place during training hours, no earlier than 20 hours and no later than 40 hours after the start of the course. If it is not possible to appoint trainee representatives, the training organization draws up a statement of failure to act, which it forwards to the regional prefect with territorial jurisdiction.
Delegates are elected for the duration of the course. Their functions come to an end when they cease, for whatever reason, to participate in training.
If the titular delegate and alternate delegate have ceased their functions before the end of the training session, a new election is held under the conditions set out in articles R.6352-9 to R.6352-12.
Trainee representatives make any suggestions they can to improve the course and living conditions of trainees in the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions and to the application of internal regulations.

Article 6: Health and safety

Preventing the risk of accidents and illness is imperative, and requires everyone to comply fully with all applicable health and safety regulations. To this end, general and specific safety instructions in force within the organization, where they exist, must be strictly observed, failing which disciplinary action may be taken.
When training takes place on the company’s site, the general and specific safety instructions applicable are those of the company where the training will be carried out.

Article 7

A copy of these rules is given to each trainee (before final registration).
